Our Approach

Despite Switzer Litigation forming in 2017, the members of our firm bring decades of collective experience representing many types of individual and corporate clients in all manner of civil litigation disputes.  Our collective experience has helped us to appreciate what is typically important to clients in understanding the litigation process and being able to make decisions with the guidance of their counsel.  Here is an overview of our process:

1. We evaluate the liability and damages of every case as soon as possible and communicate our evaluation in writing and discussing it in depth with our clients. We continue to update our evaluation whenever a development occurs that changes our evaluation (i.e. discovery of new evidence or legislative changes).
2. As part of our evaluation process, we provide an assessment as to what the probable outcome of a trial would be, what we can likely settle the matter for at the time, what we may be able to settle the matter for in the future, what we recommend that the matter settle for, and our recommendation on which option is in the best interests of our client. This way, our clients can make decisions about what offers to make, when to make them, and how an offer compares to what the result would be if the matter proceeded to a trial.
3. We recommend any investigative steps that should be undertaken and why they should be undertaken. We update our recommendations as the matter proceeds through the process.
4. We provide overall and stage specific budgets that consider fees and expenses and we honour our budgets.
5. We provide options for how to achieve results with each step of the litigation process by using our knowledge of litigation strategy and various legal options with a view to achieving results promptly and cost-effectively.
6. We use our experiences with the courts, judge, juries, and opposing counsel to be predict probable results so that our strategy is more effective and anticipatory.
7. We keep the same team working on your matter from start to finish so that each member has the benefit of being involved since the inception of the matter until the conclusion so that value is not lost by having matters transferred among various people.
8. We involve clients as much as possible in the litigation process so that they can make informed decisions and be a member of the team working towards the client’s goal.
9. We involve the finest third party service providers where necessary to assist in achieving desired results. For example, we hire the experts in a field when a legal opinion is required or we hire talented investigators when we require investigation.
10. We tackle each step of the litigation process with an eye for the current and end results while bearing in mind that while settlement is the most desirable resolution, trials are inevitable from time to time.
